What do the police need to do to prove someone who is walking home is drunk?

For a driver, the police have all kinds of tests and checks to determine whether the driver is under the influence of booze. But, it seems that a cop can just see someone “staggering” home, and throw him or her in the slammer. Is that true, or do the police need to adminster the same tests to a pedestrian as a driver before locking the drunk up?

I believe they must do the same tests… unless you are breaking the law of course. Also if you aren’t supposed to drive home drunk how else are you gonna get there?? I guess just be responsible with your drinking and this shouldn’t happen. They have ot have a reason to put you in jail!

well if you are being disorderly they can…. but being normal and walking home while drunk is better than driving.
